MCC NEET PG 2024 Delhi HC Reviews Plea on PwD to General Seat Conversion

The Delhi HC (Delhi High Court) sought a response from the Medical Counselling Committee (MCC) and the Union of India after a group of Persons with Benchmark Disabilities (PwD) candidates filed a plea against the PwD to General Seat Conversion for MCC NEET PG 2024 counselling.

 

 

The PwD candidates had filed a petition against the PwD to General Seat Conversion for the third round of MCC NEET PG 2024 counselling. This article discusses the petition submitted regarding PwD to General Seat Conversion and the importance of MCC NEET PG 2024 counselling.

 

 

The Plea Against PwD to General Seat Conversion for MCC NEET PG 2024

 

There was a high number of vacant seats in the PwD category after the second round of MCC NEET PG 2024 counselling. The counselling authority had decided to proceed with PwD to General Seat Conversion.

 

  • Preservation of PwD Seats: The PwD candidates filed a petition to the Delhi HC (Delhi High Court) against the PwD to General Seat Conversion. They sought the Delhi HC’s (Delhi High Court) intervention to preserve PwD seats till the stray vacancy round. The third round of MCC NEET PG 2024 counselling commenced on December 26th, 2024. Majority of the PwD quota seats remained vacant even after the second round of counselling due to candidates not meeting the qualifying criteria.

  • Reduction of the NEET PG Percentiles: The counselling authority has not reduced the minimum NEET PG percentiles for PwD candidates even with the availability of a large number of vacant seats. The petitioner candidates further argued that if the union government reduces the NEET PG percentiles for the third round of counselling, PwD candidates would not be able to avail the benefit of the relaxation as the vacant seats would be converted to general.

  • Equality for PwD Candidates: The petitioners mentioned that the 5% horizontal reservation for the PwD category was designed to give equal opportunities to people with disabilities. They also emphasized that the counselling authority had reduced the qualifying percentile to ‘Zero’ last year to fill up the vacant seats. They pointed out that during the NEET MDS 2024 exam, authorities used the DCI's MDS Regulations, 2017 to relax the minimum percentile criteria for all categories, including PwD, allowing broader participation in the stray vacancy round of NEET PG (MDS) 2024 counselling. The petitioners emphasized that converting PwD seats to general/non-PwD seats is irreversible, meaning they cannot reclaim those seats.

Delhi HC’s (Delhi High Court) Take on the Plea for MCC NEET PG 2024

 

The Delhi HC (Delhi High Court), after hearing the plea, issued a notice to MCC and the Union Government. One of the statements in the notice said “Looking at the nature of urgency expressed by learned counsel appearing for the petitioners, who contend that the seats, if not filled up, would be converted to general category, the Registry is directed to list this matter before the vacation Bench on 30.12.2024.” The MCC and Union Government will be filing a reply for the plea against PwD to General Seat Conversion on December 30th, 2024.
