NEET PG 2024 SC Hearing on Article 14 rules out Domicile-Based Reservations

Petition for the Rule Out of Domicile-based Reservations for NEET PG 2025

 

Three Justices, Hrishikesh Roy, Sudhanshu Dhulia, and S V N Bhatti, appealed to the Supreme Court regarding the exclusion of domicile-based reservations, which prioritized candidates from a specific region or state. This kind of reservation, they said, would be an invasion of the fundamental rights for several students. According to their petition, all the Indians are domiciled in the territory of India. Candidates must not be restricted just because they belong to a particular state. They must instead be given the freedom to choose their residence to pursue their education, business, and profession.

 

They stressed the right for Indians to move anywhere freely across the country and not be restricted to a particular state or region. They further added that the benefit of reservation can be given to a certain degree for MBBS courses to those residing in a specific state. Setting domicile-based reservations would be a violation of the equality clause in Article 14 of the Constitution.

Supreme Court’s Take on the Petition During the NEET PG 2024 SC Hearing

 

The NEET PG 2024 SC Hearing supported the appeal by the Justices and proposed a judgement in their favor, highlighting the violation of Article 14 of the Constitution. The NEET PG 2024 SC Hearing further stated that apart from a reasonable number of reservations for the state quota, seats must strictly be based on merit for NEET PG 2025.

 

The High Court held certain provisions made by Government Medical College and Hospital, Chandigarh, as invalid. On 28^th March 2019, the college had 64 medical seats dedicated to candidates residing in Chandigarh or those from the same college, restricting eligible candidates from other domiciles from getting admission to that college. According to the High Court, 32 of these seats could have been set aside for institutional preference, whereas the other 32 seats could be for candidates across other domiciles. The 32 seats were ‘wrongly filled’ according to the NEET PG 2024 SC Hearing.
