The National Medical Commission (NMC) noticed that some of the medical colleges were charging MBBS fees for all the 5 or 5.5 years. This, however, is wrong according to the National Medical Commission (NMC) as the students were being charged for time when no teaching happens (1 year or 1.5 years). According to the sections 10 and 24 of the NMC Act 2019, the duration of the MBBS course is divided into two; 4.5 years for academic study (classes, exams, teaching) and 1 year for Compulsory Rotating Medical Internship (CRMI). The internship part consists of training and practical work and is not actual classroom training. 

Supreme Court Case Regarding Payment of Fees

In the case submitted by Abhishek Yadav vs Union of India, issues were raised regarding non-payment of stipend during internship. Candidates were paying the fees for the internship (for the 1 year tenure). The Supreme Court took these issues seriously.

 

The Supreme Court stated that candidate fees must be reasonable, transparent, and non-exploitative. It must be based on actual teaching and training services. The NMC stated that failure to adhere to the rules and regulations will result in strict action against the institutes.
